Problem

Rob had 2 drunk driving convictions. He had never attended Alcoholics Anonymous. Further, he had continued to drink alcohol after attending several different treatment programs.

Result

I won Rob’s case. For the hearing, I had submitted a favorable substance abuse evaluation, negative drug screen and letters confirming abstinence. The evaluator thought that Rob needed to attend a relapse prevention program because he was at risk for a future relapse. Rob attended the program and the evaluator thought that Rob had an excellent chance for maintaining his abstinence into the future. Rob testified convincingly on the value of this program. Also, he testified about some of the changes he had made in his life consistent with maintaining long-term abstinence.

Bottom line

I argued that Rob should be given his driver’s license because he had a low risk of drinking in the future. The hearing officer agreed and reinstated his driving privileges.
