Traffic ticket convictions often result in significant rate hikes, since your insurer may view you as a higher risk.
CIVIL INFRACTIONS
Many common Michigan traffic offenses are classified as civil infractions and are not considered a crime. Examples of civil infractions are:
- Speeding
- Careless driving
- Failure to signal
- Improper lane use
- No turn on red
- Failure to stop in the assured clear distance
- Disobey traffic device and stop sign
- Improper turn
Since a civil infraction is not a crime, you are entitled to a hearing in front of a Magistrate or Judge. You do not have the right to a jury trial. The prosecutor must prove the case by a preponderance of the evidence (not beyond a reasonable doubt as in a criminal case).
CRIMINAL OFFENSES
Some Michigan traffic offenses are crimes. Drunk driving, Driving Without a License and Reckless Driving are common examples. You are entitled to a jury trial and the prosecution must prove its case beyond a reasonable doubt.
